COMPLAINT AGAINST WELLS FARGO?  



I'm touching base with homeowners I haven't heard from in a few weeks.  Can you update me on the status of your modification?  I've been re-reading stories from you who modification and foreclosure cases are pending.  Your experiences make me asbsolutely furious!

The correspondence between you and Wells Fargo Executives is typical of the way Wells is now famous for handling their homeowners.  It never ceases to amaze me (and in states where one way phone recordation is admissible in Court we do have evidence of this) how little concern or regard this company has for it's distressed customers.  

Good bye, and good riddance, Wells Fargo.

THIS KEEPS YOU HANGING ON LONG ENOUGH TO FORECLOSE ON YOUR HOME....
Every Wells Fargo staff member is trained to confuse the homeowner, to balance them between hope and discouragement, using delay tactics like bait and switch, good guy bad guy, lost documents, lost messages, and yes you've been approved, no, more money and then maybe, now yes, no you haven't, maybe yes, no we can't because, maybe, yes, oh no foreclosed last week, it's too late for you to refinance (whew, had you tried you would have found us out, why we couldn't modify your mortgage because in face we never owned it) and it's too late for you to sell it.

They do this to you because they have lied to you, they are liable.  They certainly don't want you to know:

DEFENSES AGAINST A PETITION TO FORECLOSE
  1. they have no legal way to modify your loan;
  2. or foreclose on your property;
  3. they are only the servicers of your loan;
  4. the promissory note and the mortgage are held by two separate and distinct entities;
  5. when the note and mortgage are split, the mortgage fails, it no longer can be enforced;
  6. it is not possible to rejoin the note and mortgage by subsequent assignment of the mortgage;
  7. once the mortgage is held by a separate entity than the note, the mortgage is no longer of any legal effect and should have been immediately released by the entity holding the mortgage.
AFFIRMATIVE DEFENSES
  1. accord and satisfaction, estoppel, failure of consideration, fraud, laches, license, payment, release, statute of frauds,statute of limitations and waiver
OTHER DEFENDANTS NAMED?  CONSIDER OF YOU HAVE CROSSCLAIMS

IF YOU HAVE A COUNTERCLAIM AGAINST WELLS FARGO (AND YOU DO) YOU MUST STATE IT

Homeowners are winning suits all over the country -- even homeowners who have already lost their homes.  It's never too late to fight back!

So don't lose heart.  Remember "If God brings you to it, He will bring you through it.  Happy moments, praise God.  Difficult moments, seek God.  Quiet moments, seek God.  Painful moments, trust God.  Every moment, thank God.
