Foreclosures skyrocket, State tries to help...(who, really?)

Foreclosures skyrocket here in Delaware over the past 12 months, and now, state officials are meeting at a foreclosure summit to come up with ways to combat the challenge.

The seed was planted with the subprime mortgage crisis, and the problem has gotten worse. Foreclosure filings in Delaware tripled over the last year to 6,500.

Anas Ben Addi, Director of the Delaware State Housing Authority, says there’s a number of state programs that can help struggling homeowners.

“The Delaware Emergency Mortgage Assistance Program that offers up to $15,000 deferred loan. We have H-GAP that offers a grant for $5,000.

He offers this advice to anyone who fears losing their home.

“Call your lender. Your lender is not a property manager. They’re not in the real estate business. They’re not interested in owning your property. They will be the first to work with you to keep you in your house.” DinSFLA: Obviously, he is not in the real world, They are not helping! If a lender is selling bank owned this makes them “in the business”.

For those, who’ve already fallen over the edge and filed for foreclosure this year, Ben Addi says there’s help for you too.

“The Neighborhood Civilization Program that helps community rehab and sell. We have rental assistance for folks, who went through foreclosure, and we’ll be talking about this – how can we better use it and get the word out.”

Shares of DJSP Enterprises, Inc (DJSP) traded recently at $6.38 per share, down from its 52weekHigh of $13.65 per share.

Wells Fargo Financial closes Canadian operations

CANADA IS SAFE!

Wells Fargo Financial is closing up its Canadian operations and no longer offering consumer loan, the Des Moines based company confimed Friday.

“We have shifted our focus to serving existing real estate, auto, and consumer loan accounts. There will be no change to our customers’ existing account terms and conditions,” the company says on its website:

Wells Fargo Financial had 120 stores in Canada, and approximately 800 Wells Fargo team members in the country will be impacted, said Diana Rodriguez, vice president of communications for Wells Fargo Financial. Des Moines operations of Wells Fargo Financial will not be impacted, she said.

There are approximately 450 Wells Fargo team members who will remain in Canada to service the existing loan portfolio, Rodriguez said.

“Wells Fargo’s loan origination business in Canada has not been generating sufficient financial returns,” she said. “So we’re making the difficult, yet prudent decision to cease originations at this time.”

Rodriguez stressed that it was just Wells Fargo Financial stores affected and other divisions of the bank still have “robust operations” in the country.

The Financial Post reports, however, that U.S.’s fourth largest bank has made several moves out of the Canadian market in recent years.

Wells Fargo “began to withdraw consumer lending from Canada in 2008 at the height of the financial and economic crisis. In November 2008, it decided to exit the indirect auto-lending business,” the newspaper said. “Then, last July, Wells Fargo stopped offering residential mortgages and home-equity loans in Canada.”

Three More Suspects Nabbed in Million-Dollar Bait-and-Switch Home Refinance Scam

LOS ANGELES – In a continuing probe into a defunct Southern California mortgage brokerage, Attorney General Edmund G. Brown Jr. today announced the arrests of president and co-owner Sean McConville and two associates who used “deceptive promises and forged documents” to steal almost $1 million from homeowners falsely guaranteed attractive home loan refinancing packages.

“These criminals employed a classic bait-and-switch in their refinance scheme,” Brown said. “With deceptive promises and forged documents, they maliciously cheated homeowners who trusted them and just wanted a fair deal.”

Brown’s office initiated its investigation in October 2008 in response to more than 70 complaints against the defendants and their mortgage brokerage business, ALG Capital, Inc. The brokerage operated out of Calabasas from early 2006 until late 2007 and then moved to Mission Hills until it shut its doors in 2008.

Brown’s investigation found that f! rom April 2007 to October 2008, the owners and their associates lured dozens of borrowers into refinancing home loans by falsely promising low interest rates, minimal broker fees and other attractive terms. The brokerage then negotiated different terms with lenders.

When homeowners were presented with closing documents, they bore the terms promised, but which the lenders never approved. After homeowners signed the closing documents, key pages were removed and replaced with pages bearing the terms that the lender had actually agreed to. The homeowners’ signatures were then forged on the replacement pages, and ALG forwarded the forged documents to the escrow company.

Homeowners only discovered they had been defrauded when they received the final loan documents with the true terms and their signatures forged on closing cost disclosures, Truth-in-Lending disclosures, loan applications and other documents.

Additionally, ALG collected al! most $1 million in undisclosed fees, charging homeowners up to! $57,000 in broker fees. In total, dozens of homeowners were locked into almost $30 million in loans with terms they did not agree to.

As a result of this scheme, many homeowners were forced to sell their homes, come out of retirement, or tap retirement savings. Others paid significant prepayment penalties, including over $21,000 in one case. Borrowers also rarely received the large cash-outs they were promised as part of the refinance.

Sean McConville, 30, of Austin, Texas, president and co-owner of the brokerage, was arrested early yesterday morning at his residence. He is being held at the Travis County Jail in Texas pending extradition. He was previously convicted of robbery in November 1997.

Matthew Bourgo, 27, of Thousand Oaks, who posed as a licensed notary for the brokerage, was arrested yesterday afternoon at his residence. He is being held in Ventura County Jail and will be transferred to Los Angeles County.

Joseph Nguyen, 37, of Woodland Hills, a former loan officer for the brokerage, was also arrested yesterday afternoon at his business, where he worked as a chiropractor. He is being held by authorities in Los Angeles County.

The suspects are each being held on $29.5 million bail.

In September 2009, Brown’s office arrested three others involved in the bait-and-switch scam, including Michael McConville, 32, of Simi Valley, Sean’s brother and co-owner of the brokerage, Alan Ruiz, 29, of Huntington Beach, a former loan officer and Garrett Holdridge, 24, of Palmdale, who was convicted of seven felonies in March for his involvement in the scam.

Investigators located victims in dozens of California cities, including: Auburn, Altadena, Arroyo Grande, Azusa, Bakersfield, Berkeley, Burbank, Calabasas, Castro Valley, Chino, Compton, Corona, Fairfield, Fontana, Fremont, Fresno, Garden Grove, Glendale, Hemet, Highland, Huntington Beach, La Habra! , La Mesa, La Mirada, La Quinta, Lancaster, Livermore , Los Angeles, Lo! ng Beach, Manteca, Martinez, Monterey, Murrieta, Nice, Northridge, Oakland, Ontario, Palmdale, Pasadena, Perris, Petaluma, Pomona, Quartz Hill, Rancho Cucamonga, Redlands, Reedley, Rialto, Sacramento, San Clemente, San Diego, San Jose, Santa Rosa, Sierra Madre, Spring Valley, Stanton, Temecula, Whittier, and Winnetka.

The complaint, filed in Los Angeles County Superior Court, includes the following charges: 38 counts of grand theft, 19 counts of forgery, three counts of elder abuse, and one count of conspiracy to commit grand theft.

Brown also filed suit against the McConville brothers in May 2009 for running a property tax reassessment scam which targeted Californians looking to lower their property taxes. The brothers billed tens of thousands of homeowners throughout California nearly $200 each for property tax reassessment services that were almost never performed and are available free of charge from local tax assessors.

Never was late in a payment, for 20 years, paid 1,200 on time, time every month, time are are tough and thought maybe with my reduced income I would enroll in the Hamp program, through my mortgage company Wells Fargo, and maybe receive a reduced interest or payment, Sent in all paperwork, tons of it, receive a trial period payment of 620.00 a month, paid on time for 4 months, Bank says after 4 months unable to create an affordable payment equal to 31% of monthly gross income without changing the terms of your loan beyond the requirements of the program. Now I'm receiving letters and phone calls that my mortgage is in default, acceleration to foreclosure is in place. I was never late in payments, and have 3 years left on my mortgage. my home is worth 400,000 and I owe 30,000. They are trying to take my home while in the Hamp program.

This has affected my credit, late fees, Wells Fargo does not care if your in the program. they say I'm in review for alternative loss mitigation solutions, maybe for in-house, people really have no clue. Collections are calling my home now and acceleration is in process due to Hamp program. I could lose my home because of this after paying 20 years, with over 80% equity, This program is taking away homes from hard working people. i can not believe this could happen in America with the Government and a reputable Bank, What is happening?

Dear Jeff,

Oh Jeff, I didn't either. I just read an article that said in the 1980's over 500 banks went under during the savings and loan crises! To date since this started in 2004 (I think that's right) so far 140 banks have closed so "they" say what we are experiencing isn't nearly as bad. I search my brain for memories of the 1980's and wonder what planet I was living on. I don't remember experiencing anything like this! I was in my 20's...

sigh.....yes, unfortunately yes. If they can figure out a way to keep your money and hide the fact that they ever talked to you about it, they'll do it. They are a creepy bunch.

If you have equity, can you get it out? Can you refinance? Are you stuck on your home? Can you strategically default? Stop making your payments? It will take them quite a while to get you out....save up your money......buy something new, I'm just saying....

I hear ya.

Back in December of 2009 we got papers for an Deferment for 3 months . so I made a payment and 2 days after that I got papers for the loan modification so I called and got Michelle “employee ID GHH” and asked what was going to happen with the payment I just made . she went back to her supervisor 4 times just to make sure he was right in telling me that the payment for the deferment would be the first payment on my loan modification. Then 3 weeks later I get a Letter stating I defaulted on the modification and when I call and gave Michelle’s employee number. The only thing they could find in my notes is that she stated I talked to her. So needless to say I had to start the process all over and they say one day its approved then the next it isn’t so now I just get something where they added the past due onto the payments which are way over what I am paying now
